Your AI Chat Is Not Your Lawyer

A federal judge ruled that a man's chats with a consumer AI tool were not protected by attorney-client privilege. Here's what that means before you type.

Your AI chat is not your lawyer. A federal judge just said so.

It feels private. You're alone with a text box, it answers in full sentences, and it never tells anyone. But in February 2026 a federal judge in New York ruled that a man's chats with a consumer AI tool were not protected by attorney-client privilege. If you've ever typed a legal question into a chatbot, that's worth five minutes.

What happened

The case is United States v. Heppner, in the Southern District of New York, before Judge Jed S. Rakoff. The defendant learned he was a target of a federal securities fraud investigation. On his own, without his lawyers telling him to, he used the consumer version of Claude to work through his defense: what he might argue, how the facts and the law might play out. Later he tried to keep those chats out of the case as privileged.

The judge said no. The chats weren't protected by attorney-client privilege, and they weren't protected as attorney work product either.

Why the judge said no

Two reasons, and both are simple.

First, an AI platform is not a lawyer. Privilege protects a relationship with a licensed professional who owes you duties. A chatbot isn't that.

Second, the privacy policy. The provider's terms said user inputs could be collected, used for training and shared with third parties. When you agree to that, the court found, you don't have a reasonable expectation that the conversation stays confidential.

There's a second edge here that lawyers have pointed out. If you paste your lawyer's advice into a consumer AI tool, you may be handing over privilege on that advice too, because you've shared it with a third party.

What it didn't cover

Fair is fair. This was a public consumer tool, used by a criminal defendant on his own, in a criminal case. The ruling did not address business or enterprise AI plans, or tools a lawyer directs you to use. That doesn't make those safe. It means this judge didn't decide them.

And I'm a broker who builds AI tools, not a lawyer. This is not legal advice. If you have a legal question, ask your attorney.

My rule

Would I say this to a stranger? If not, I don't type it.

Counsel first, then AI. If something has a legal angle, I talk to my lawyer before I talk to a chatbot about it, not after.

For work, I use paid business plans and I read their data terms. Remember, the ruling didn't address those plans, so that's a habit, not a guarantee.

And for anything that has to stay in the building, I run a model on my own machine, so the conversation never leaves it.

These tools make you feel like you can do all the lawyer stuff yourself. You shouldn't. Find a lawyer who specializes in what you need. They're worth their weight in gold.
